These terms apply to your use of this website and to the services Midnight Media provides. By using this site or engaging us, you agree to them.
Programme description. Midnight Media sends conversational text messages to business owners who have agreed to receive them — for example, a link to work discussed on a call, an appointment confirmation, or a reply to a question you have asked us.
How you opt in. You consent to receive text messages from us either by submitting the contact widget on this website, or verbally during a phone call with one of our representatives. Where consent is given verbally, we record it against your contact record with the date and time.
Message frequency. Message frequency varies and depends on your interactions with us. We do not send bulk or broadcast campaigns.
Cost. Message and data rates may apply, depending on your mobile plan. Midnight Media does not charge you for messages.
Opting out. Reply STOP to any message to stop receiving texts from us. You will receive one confirmation message and then no further messages. You can also ask us to stop by phone or email.

Consent is not a condition of purchase. You do not have to agree to receive text messages in order to buy anything from us.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.

We design, build, host and maintain websites for businesses. The specific scope, price and timeline for your project will be set out in the quote or proposal we give you. That quote, together with these terms, forms our agreement.
You are responsible for providing content, images, and approvals in a timely way, and for ensuring you have the right to use any material you supply to us. Delays in supplying material will delay delivery.
On full payment, you own the finished website content and design we produce for you. We retain ownership of any underlying tools, templates, frameworks or components we reuse across projects, and we may display the finished work in our portfolio unless you ask us not to.
Your website may rely on third-party services such as hosting, domain registration, fonts, or booking tools. Those services are governed by their own terms, and we are not responsible for their availability.
Nothing in these terms excludes any guarantee, right or remedy you have under the Australian Consumer Law. To the extent permitted by law, our liability for any claim relating to our services is limited to resupplying the services or refunding the amount you paid for them. We are not liable for indirect or consequential loss, including lost profits or lost business.
Either of us may end an engagement in writing. If you cancel partway through, you are responsible for the work completed up to that point.
We may update these terms from time to time. The version published on this page at the time you engage us is the version that applies.
These terms are governed by the laws of Queensland, Australia.
