This policy explains what personal information Midnight Media collects, why we collect it, and what we do with it. We handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

Information we collect

We only collect information you give us directly. That includes:

Contact details — your name, business name, phone number and email address, when you enquire with us, book a call, or speak with one of our representatives.
Project information — details about your business and website that you share so we can quote or build for you.
Correspondence — notes and records of calls, messages and emails between us.

We do not buy contact lists, and we do not collect sensitive information as defined by the Privacy Act.

How we use it

To respond to your enquiry and prepare quotes or proposals.
To deliver, host and support the work you engage us for.
To arrange and confirm appointments.
To send you information you have asked for, or agreed to receive.
To meet our legal and tax obligations.

Text messages and phone calls

We only send text messages to people who have agreed to receive them. Consent is given either by submitting the contact widget on this website, or verbally during a phone call with one of our representatives, in which case we record that consent against your contact record along with the date and time.

Message frequency varies. Message and data rates may apply. Consent to receive messages is never a condition of purchase.

You can stop messages at any time by replying STOP to any message from us, or by emailing us at the address below. Reply HELP for assistance.

Mobile information will never be shared or sold to third parties or affiliates for marketing or promotional purposes. No mobile information is shared with third parties for their own marketing purposes under any circumstances.

Who we share information with

We do not sell your personal information. We share it only with service providers who help us operate, and only to the extent they need it — for example our CRM and messaging platform, our website hosting provider, and our accountant. These providers are bound to use the information only for the services they provide to us.

We may also disclose information where we are required to by law.

Overseas storage

Some of the services we use store data on servers outside Australia, including in the United States. Where that happens, we take reasonable steps to ensure the provider handles your information consistently with the Australian Privacy Principles.

How long we keep it

We keep your information for as long as we have an active relationship with you, and afterwards only for as long as we need it to meet legal, tax or record-keeping obligations. After that we delete or de-identify it.

Security

We take reasonable steps to protect the information we hold from misuse, loss, and unauthorised access or disclosure. No system is completely secure, but we limit access to those who need it and use reputable providers.
